Official Raffle Rules and Conditions ***AMENDED Annual Activity License, Number 17202, Reference 159125**** Men Of Vision Empowering Inc. is a 501(c)(3) nonprofit service club (EIN #87-3771607) engaged in service activities and charitable giving in the greater Indianapolis area. The M.O.V.E. Inc. Motorcycle Raffle (“Raffle”) is conducted for the purpose of generating operating funds to support the charitable activities of MOVE Inc., including but not limited to local community service projects, grants to local nonprofit organizations, and scholarships.
1. ELIGIBILITY The Raffle is open to any eligible U.S. Resident. All entrants must be 18 years of age or older. Each entrant, by entering the Raffle, agrees to abide by all of the rules and conditions contained herein, as well as all applicable local, state and federal laws and regulations. Waiver/Limitations of Liability Ticket purchasers, by participating, and winners, by accepting a prize, release, and hold harmless MOVE Inc., and their respective board, staff members, members, volunteers, partners, vendors, agents, representatives, sponsors, service agencies, and independent contractors, and each of their respective directors, officers, partners, employees and agents, including advertising, public relations, direct marketing and promotion agencies, from any and all liability with respect to participation in the promotion and possession or use of the prize(s) awarded and also acknowledge that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness.
TICKET PURCHASE The cost to purchase a single entry ("Ticket") for the Raffle is $25.00 (U.S. Funds only) and is not tax deductible. Any entrant may purchase more than one Ticket. An entrant can enter the Raffle by purchasing a Ticket from a MOVE Inc. representative. Ticket payment may be made by VISA, Mastercard, Discover Card, cash, or check. MOVE Inc. and its agents, Board, vendors, volunteers, and members assume no liability for lost, late, misdirected, mutilated, incomplete, illegible, misprinted, undelivered entries or entries without proper payment received, which entries shall be deemed invalid and shall be immediately disqualified. Official Raffle Rules and Conditions If an entrant's payment is dishonored by a bank for any reason, such entrant's Ticket will be declared invalid unless full and satisfactory payment is made prior to the respective Raffle drawing. Any dishonored credit card will be considered an invalid entry, and MOVE Inc. will endeavor to notify the entrant. Completed entry ticket forms must be in the possession of MOVE Inc by 6:00PM (Eastern) on Saturday, March 30th, 2024, or before 3000 valid Tickets are sold, whichever comes first, to be eligible for the prize drawing. All ticket forms will be handled and recorded on a first come, first served basis. Any ticket forms and payments (including payments previously dishonored) received after closure of the Raffle will be returned to the entrant. Upon receipt of a completed registration form and valid payment, a Ticket with assigned drawing number will be issued. The Ticket shall be delivered to the entrant at the time of sale. All purchases of Raffle Tickets are non-refundable after an entry has been included in any prize draw, unless the Raffle has been cancelled under the terms listed in Section 6 below. Privacy Policy - All user data, including credit card information, will be encrypted on a secure page; - No credit card information will be stored; Information collected during a purchase will only be used to contact a winner of the raffle and internally for future raffles; and - No information will be sold or shared with any third-party websites or companies
3. PRIZES If the Motorcycle Raffle is not modified or canceled under the terms of Section 6 of the rules, MOVE Inc will award one (1) Grand Prize to the lucky winner. In the event that a winning Ticket has more than one (1) name listed, MOVE Inc will award the prize to the first name listed on the entry. The records of MOVE Inc. shall be deemed correct if there is a discrepancy or dispute. MOVE Inc. is not responsible for resolving any disputes that may arise from different individuals listed on a valid Ticket. Prizes are not transferable and must be claimed by the person whose name is on the Ticket. GRAND PRIZE. The Grand Prize Winner (“Winner”) shall be awarded the 1978 Custom Harley-Davidson Shovelhead Motorcycle (“Prize”), as advertised on the ticket. The prize is subject to applicable income tax withholding requirements. The Grand Prize Winner shall be solely responsible for any and all fees, license and documentation fees, and vehicle delivery charges. In the event that the winner is unable to satisfy the responsibility for any of the above-listed fees or obligations, a second winner will be chosen at random.
4. DRAWINGS The winner of the Grand Prize Motorcycle will be determined by a random drawing of all the eligible Tickets received by the entry deadline. The Grand Prize will be announced in person at Community Alliance of The Far Eastside (CAFE), 8902 East 38th St., Indianapolis, IN 46226-6073, Friday, March 30th, 2024 at 6:30pm once drawn from all valid tickets received by 6:00 pm that day. The Grand Prize Drawing announcement will be posted to www.menofvisionempowering.org immediately following the drawing. All drawings will be video recorded. Winners need not be present to win.
5. WINNING CHANCES A maximum of 3,000 Tickets will be sold. Each Ticket represents one chance to win. You may enter as many times as you like. Chances of winning a prize depend on the number of eligible Tickets sold. For the Grand Prize, if 3,000 tickets are sold, your chance of winning the grand prize is 1 in 3,000 with one ticket purchased. The actual odds of winning a prize in any drawing are dependent on the number of eligible Tickets sold and available for the drawing.
6. MODIFICATION OR CANCELLATION OF DRAWING; CONVERSION TO 50/50 RAFFLE MOVE Inc. reserves the sole discretion to cancel or modify the Raffle. If fewer than 1500 tickets are sold by March 30th, 2024, MOVE Inc, at its sole option, may modify the Raffle by converting it to a 50/50 raffle where 50% of the funds collected, minus expenses, will be paid to the winner as a cash prize (this change would be posted on www.menofvisionempowering.org/Raffle .
7. WINNER Winner will be notified by phone, e-mail and/or by mail at the contact information (phone, email, and mailing address) listed on the Ticket. Winner shall confirm their acceptance of the Grand Prize, in writing, to MOVE Inc within thirty (30) days from the date that Winner is notified of the results of the drawing. Winners’ first and last name, city and state will be available to all media and will be available on MOVE Inc’s website. Winning entrants agree to allow MOVE Inc. to use their first and last name, likeness, and any statements made by them regarding the prize for advertising or publicity purposes, in perpetuity, without review, permission, or compensation. No information will be sold or shared with any thirdparty websites or companies. Winner may be required to complete and return an affidavit of eligibility and/or liability release and required tax forms, and must submit their social security number to MOVE Inc. for that purpose. Winner’s failure to do so if requested or if Winner otherwise fails to comply with these rules and/or to make arrangements to claim their prize within thirty (30) days of a drawing notification will void that entry. If Winner cannot be contacted or located by reasonable means after a period of thirty (30) days from the date of any Raffle drawing, the prize will be deemed forfeit and a new winner will be drawn. If a new winner cannot also be contacted after a period of 30-days, the grand prize shall be considered to have been donated to MOVE Inc. for its charitable purposes.
8. AUTHORITY AND CONTROL The decision of MOVE Inc. shall be final in all matters concerning the Raffle. The Raffle is subject to the laws, ordinances, and regulations of the State of Indiana and City of Indianapolis. The Raffle is void where prohibited by law. MOVE Inc is not responsible for any errors or omissions in the Raffle's advertising and/or any printed, broadcast, or Internet-provided materials or information.
